Terms and Conditions
HIMLEY CHRISTMAS FESTIVAL LTD
This event will operate from Friday 26th November 2021 to Sunday 12th December 2021 and will be open to the public from 5pm-9pm every day. There will be an earlier set up time for Trade Stands and Catering/Bar Concessions.
Please read the following terms and conditions. The completion of the booking form and sending the application is deemed to having read and accepted these terms and conditions.
The term “Vendors” refers to Stallholders, Catering and Bar concessions
The term “Festival” refers to Himley Christmas Festival
All Vendors must have valid Public Liability Insurance appropriate to their business activity and must be able to provide evidence (a certificate) upon request. Failure to produce evidence of valid Public Liability Insurance will render your application void.
Stalls/Catering/ Bar concessions will be granted for the duration of the event only. Under no circumstances can stalls/catering/ bar concessions be transferred, sub – contracted, gifted, or sold to another Vendor without written express consent from the Organiser.
Vendors are not permitted to leave stock overnight. Catering and Bar units may be left on site for the duration of the Festival, with the prior agreement of the Event Organiser and the Venue, this is done so entirely at your own risk and neither the Event Organiser nor the Venue accept any responsibility for loss or damage.
Vendors are liable for any acts and omissions of any of their employees and/or representatives.
The Event Organiser (Himley Christmas Festival Ltd) accept no responsibility for loss, liability or damage suffered or incurred by reason of any claim made or proceedings instituted against the Stallholder/Catering/Bar Concessions by any individual or company.
Vendors are responsible for their stock and equipment at all times, this includes during set-up and breaking down and throughout the Festival, the Event Organiser (Himley Christmas Festival Ltd) does not accept any responsibility for damage, loss or injury incurred in relation to displays or items being showcased or sold.
Any damage or loss of equipment provided by the Venue, or the Event Organiser (Himley Christmas Festival Ltd) will have to be repaired, reimbursed or replaced at cost to the Vendor.
The Event Organiser (Himley Christmas Festival Ltd) does not accept any responsibility for any injury, loss or damage inflicted on members of the Public, Event Staff, other Vendors etc, that has arisen as a result of the actions of Vendors due to their own negligence.
ADVERSE WEATHER CONDITIONS
Himley Christmas Festival is an outdoor event, and as such may be subject to adverse weather conditions. The Festival, will not be cancelled due to weather conditions unless there is a significant serious health and safety risk.
If the Festival is cancelled, whether it be for one day or the full duration for reasons beyond our control there will be no compensation for loss of earnings.
COVID – 19
All Vendors (including any additional personnel staffing stalls) must comply with the relevant Covid – 19 Government guidelines. The event Organiser (Himley Christmas Festival Ltd) will check and ensure that guidelines are being adhered to throughout the duration of the event.
Please indicate on your registration if you require power. All electrical items used will require a valid PAT certificate. Domestic appliances are not permitted. Please state on your application if you intend to use your own generator.
Vendors are responsible for obtaining and complying with all the appropriate licenses that apply to their business activity. Prior to the booking confirmation, you will be required to produce evidence of the license(s).
